§ 1 Scope of Validity
(1) These general terms and conditions of business are applicable for all business relations between concertposter.com and its customers, in the respective current version at the time when the contract is agreed.
(2) Our general terms and conditions of business are applicable exclusively. Terms and conditions of the customer that are contradictory to or which differ from our terms and conditions of business are not recognised unless concertposter.com has expressly agreed to these in writing, in the individual case.
§ 2 Prices, Offers
All offers are non-binding and without engagement. Illustrations are non-binding. Improvements or modifications to the service are permitted, provided that these are reasonable for the customer in consideration of the interests of concertposter.com. The right to price adjustments is reserved. In the event of a price increase, the customer is not bound to the order. All prices are stated inclusive of statutory value added tax. Order cancellations may be made no later than within 24h. Concertposter.com provides no guarantee for the delivery periods specified in the programme.
§ 3 Delivery
The delivery is made at cost and risk to the customer/orderer. On transfer of the goods to the carrier, the risk is transferred to the orderer. On request, cargo insurance can be taken out for the total value of the delivery. This will be at cost to the customer. The period of delivery is generally 5 – 7 workdays within Germany and 8 – 14 days within Europe.
§ 4 Deliveries Abroad
In the event of payments/deliveries in foreign trade, all additional costs, expenses, fees, taxes and export duties shall be at the expense of the recipient. Should the orderer export goods supplied by concertposter.com, the orderer must observe the respective statutory regulations for export. Overseas deliveries will be sent by airmail. The period of delivery is generally 10 –15 days. However, in our experience, in isolated cases, delivery can take up to 6 weeks.
§ 5 Reservations of Proprietary Rights
Until the settlement of all debts outstanding against the orderer, the goods supplied remain the property of concertposter.com. concertposter.com is a domain of Jundel Handel GmbH. By ordering from our website, the purchaser accepts our terms and conditions of business, to the exclusion of all other terms and conditions of business.
§ 6 Concert Posters
| Concert posters come in two sizes: |
DIN A1 (60 x 84cm / 23 x 33 inches) DIN A0 (84 x 118cm / 33 x 46 inches) |
The dimensions specified here are approximate sizes only and may differ by a few centimetres per poster. DIN A0 size concert posters may consist of 2 parts. In the event of greater deviations from the norm, an extra indication is given with the respective item.
§ 7 Return
The post office retains cash on delivery consignments for only 5 working days. Should your delivery not be collected within this period or should it not be possible to deliver the consignment for whatever reason, the orderer will be charged for the extra costs incurred as a result of return and processing.
Should the goods be uncollected despite the absence of a guarantee or warrantee, concertposter.com is entitled to charge a flat rate cost fee of 10% of the purchase price and no less than 20.00 Euro. The right to prove higher (concertposter.com) or lower (customer) costs is reserved. No repeat dispatch of the goods returned in the specific case can be guaranteed.
§ 8 Complaints
In principle, concert posters are precluded from being taken back and exchanged. We must be notified of complaints immediately and in writing, within 5 days. Shipment damages must be confirmed by the delivery agent. As we cannot be held liable for shipment damages, we reserve the right to cede claims against the carrier to the orderer. The obligation to investigate and notify of defects also remains in force if the orderer is not a trader. Our liability is limited to wilful intent and, in the case of gross negligence, to direct damages excluding revenue losses or consequential damages.
§ 9 No Verbal Agreements
Please understand that verbal agreements are not valid and that all agreements between you and us that differ from these terms and conditions of business or that do not come under their regulatory remit must be made in writing. As such, an e-mail is not sufficient.
§ 10 Applicable Law
For these terms and conditions of business and for all legal relations between concertposter.com and the purchaser, it is agreed that the law of the Federal Republic of Germany shall be applicable as mandatory. Other national laws and likewise the standard international purchasing law (EKA, EKAG) are excluded. Providing the purchaser is a tradesman in the context of the commercial code, Frankfurt am Main is agreed to be the exclusive court of jurisdiction for all disputes.
§ 11 Salvatory Clause
Should one or more clauses of these terms and conditions of usage be invalid, incomplete or in need of additional specification, this shall not affect the validity of the remaining clauses. In its/their place or in order to close contractual loopholes, regulations should be brought, which meet the economic interests of the parties as closely as possible.
